Beaver Lake Wilderness Club, Inc. (BLWC)
General Rules and Regulations
- Use of the lake is for Members, Associate Members, and Residents with deeded rights. Renters may apply for an Associate Membership, which must be approved by the Board of Directors. Associate Membership is not guaranteed or can be revoked for improper conduct.
- No area within the boundaries of Beaver Lake Wilderness Club shall be used as a dumping ground for rubbish; this includes abandoned cars, trash, junk, and garbage.
- All waste should be stored in securely lidded containers. In order to keep animals (such as bears) away from the trash cans spray them with ammonia.
- All developed lots are to be maintained with respect to mowing and fallen debris. Grass should be no higher than 8”.
- Plans for development must be filed with all appropriate agencies including Beaver Lake Wilderness Club Board of Directors, and proper permits clearly displayed. A cease and desist order will be filed if not followed.
- Notification of timbering shall be made to the Board of Directors before project is started and clean up shall be done in a timely manner.
- No trespassing, fishing, swimming or loitering on the Dam Area as ordered by the Department of Environmental Protection.
- Boating permitted with valid Boating Decals / Membership Button (if in effect); a valid BLWC Membership card in your possession and displayed. Guests using BLWC facilities must be accompanied by a member.
- Boat storage is not permitted on BLWC facility property. The boats must be removed after each day’s use.
- Fishing requires a PA State Fishing License and BLWC membership card.
- No gasoline engines can be used on the lake except as determined by the Board of Directors.
- Swimming is not permitted.
- No open fires permitted on BLWC facility property.
- Pets are to be kept under control and restricted to the owner’s property.
- No mobile homes are to be used as permanent residences in the BLWC subdivision.
- Campers are not allowed in the BLWC subdivision except by permission of the Board of Directors.
- In order to serve on a committee, the member must be in good standing. Dues must be current.
- Dues must be paid by 1/31 in accordance with the by-laws. The collection process will commence after 1/31 with no other written notice.
- All contractors and subcontractors must carry liability insurance.
All rules and regulations are in compliance with the Offering Statement, Building Restrictions, Covenants and By-Laws.

Designated Hunting and Trapping Area
22. There is a walking trail to enter the hunting area for members only on Lakeview Drive that will be marked with signs that give access to the Hunting Area, unless you have the landowner’s permission to enter the hunting area that borders the BLWC hunting area. (No vehicles at this time).
23. Safety Zone, Designated Hunting Area and No Trespassing signs are posted clearly defining this area.
24. Hunting and Trapping is only allowed in accordance with the Pennsylvania Game Commission and State Law.
25. Individuals must be safety aware and use extreme caution at all times.
26. It will be the responsibility of individual property owners to report any violators to the Game Commission or State Police.
27. Any member who violates any rule or regulation for the Hunting and Trapping Area will lose all future privileges.
28. Beaver Lake Wilderness Club is not responsible for any injuries incurred.
29. No tree stands.
30. No hunting outside the designated area.
31. No hunting on Lake Area unless approved by the BLWC Board of Directors.
32. Trapping must have BLWC Board of Directors approval.
BY-LAWS OF BEAVER LAKE WILDERNESS CLUB, INC. (Rev. 2006)
ARTICLE 1
Section 1: The name of this organization shall be the BEAVER LAKE WILDERNESS CLUB, INC. (“BLWC” or “organization”). The principle place of business of the organization is 59 Lakeside Drive, Suite 1, Muncy Valley, PA 17758.
ARTICLE 2
Section 1: The purpose of this organization is to establish and maintain a secluded mountain, lake, recreational and residential facility for the benefit of its members, and to further preserve, conserve and maintain the natural areas of the BLWC.
ARTICLE 3
Section 1: The membership of this organization shall consist of all property owners of the BLWC subdivision, in Penn Township, Lycoming County, Pennsylvania. A property owner is a person whose name appears on a currently effective, recorded deed for a property located within the BLWC subdivision.
Section 2: (A) The organization also has available Associate Memberships, which provide fishing and boating privileges on Beaver Lake. An Associate Member is defined as a non-property owner who is charged an annual fee, the amount of which is determined by the Board of Directors of the organization. Associate members must be approved by at least four (4) Board members. An associate membership may be revoked at any time by the Board if the Associate Member violates any rules or regulations adopted by the Board. Associate Members shall have no voting privileges on any matter within the BLWC. (B) Grandfathered property owners are subject to the same rules and regulations as Associate Members. (C) Renters of property located within the BLWC subdivision have no rights or privileges to use any facilities of the BLWC.
Section 3: The organization is responsible for making an annual assessment upon members. The assessment shall be made at least sixty days prior to January 1st of the calendar year for which the assessment is due, in writing, and will be sent to each member’s last known address. An assessment shall be made of each lot owner on an equal basis as it relates to the entire sub-division, for an amount as designated by the Board of Directors as necessary to meet the expenses of the organization. The organization shall be responsible for payment of the assessment on each lot which it owns, until such time as final sale of said lot is completed. Each lot owner shall be responsible for payment of the assessment on each lot that he/she owns.
Section 4: Payment of assessments is due by January 31st of the year of the assessment. The Board of Directors shall take any necessary legal actions to recover any unpaid yearly assessments owed by the members, in accordance with Section 3. A late penalty of $50.00 for each year’s assessment will be applied, plus legal expenses, and filing fees.
ARTICLE 4
Section 1: All meetings of the members of the organization shall be held at such place and time as shall be designated by the Board of Directors. All such meetings must be held within a thirty (30) mile radius of Beaver Lake.
Section 2: The annual meeting of the members of the organization shall be held during the month of August each year, at a date and time determined by the Board of Directors. The Board must provide written notice of the annual meeting to the members at least sixty (60) days prior to the date of each meeting.
Section 3: Special meetings of the members of the organization may be called at any time by the President or shall be called by the President upon the written request of ten or more members, provided the request specifies the topics to be discussed at the special meeting. Written or printed notices of special meetings, indicating the topics to be discussed, shall be given to the Secretary and mailed, at least twenty (20) days in advance of the meeting, to the last known address of all members.
Section 4: At any regular or special meeting of the members of the organization, a majority vote of the voting members present shall constitute a binding vote. Only one (1) vote may be cast per deed, regardless of the number of owners reflected on a deed.
ARTICLE 5
Section 1: A Nominating Committee of two members, not more than one of whom shall be a Director, shall be appointed by the President at least sixty days before the annual meeting of the organization. The Nominating Committee shall submit its selection of board nominees to the President at least twenty days prior to the annual meeting. Individuals interested in serving on the Board must submit their names to the Nominating Committee at least twenty (20) days prior to the annual meeting.
Section 2: Members of the Board of Directors shall be elected by ballot.
ARTICLE 6
Section 1: The officers of the organization shall be a President, a Vice President, a Treasurer, and a Secretary, all of whom shall be elected from among the members of the Board of Directors at the annual meeting of the members of the organization. The new Board of Directors each year will elect the officers for the following year.
Section 2: The officers shall serve for a term of one (1) year, and/or until their respective successors are duly elected. Newly elected officers shall take office on the first day of January of the year following their election at the annual meeting.
Section 3: The Board of Directors may appoint such administrative officers as they deem necessary, who shall have such authority and perform such duties as from time to time may be prescribed by the Board.
ARTICLE 7
Section 1: The affairs of the organization shall be managed by a board of SEVEN (7) Directors elected from the property owners. As a prerequisite for a position on the Board of Directors, nominees must be property owners in good standing, ie: all dues must be paid in full. Only property owners may serve on the Board of Directors of the Corporation, or in any administrative capacity.
Section 2: The term for Board of Director positions shall be two years. Board member terms shall be staggered such that three board positions will be filled in even years and the remaining four board positions will be filled in odd years. Board members shall be elected by the members of the organization at the annual meeting each year.
Section 3: The Board of Directors shall have such power and authority as indicated in the Pennsylvania Not-For-Profit Corporation Law. In addition, thereto, the Board of Directors shall have the following authority:
(A) To adjust and change the annual dues of the membership of the organization. Annual member dues shall not be increased more than $25.00 in any one-year period.
(B) To make and alter any rules and regulations, not inconsistent with these by-laws, for the conduct of the business and purposes of the organization.
(C) To purchase or otherwise acquire for the organization, any property, and to make improvements, additions, and alternations to real estate owned by the corporation, and to purchase equipment for use by the organization at such price and upon such terms and conditions as they shall from time to time see fit; provided however that no expenditure exceeding the sum of $500.00 may be made or contracted for without approval by a majority vote of the members present at a regular or special meeting of the organization. The Board may exceed the $500.00 spending limit without receiving prior membership approval for only emergency situations where there is an immediate need for action by the Board. A majority vote of the Board at a special meeting is required for such an emergency expenditure. Notification of the emergency expenditure must be made to the membership of the organization at the next membership meeting, or within 30 days by special mailing, whichever is sooner.
(D) To provide for the management of the affairs of the organization and also to appoint committees and to delegate any of the powers of the Board of Directors to any standing or special committee, or to any officer.
(E) To fill the vacancy of any office or Board position for the unexpired term of such office, such vacancy to be filled by a majority vote of the remaining members of the Board. In the event that the membership of the Board falls below the number necessary for a quorum, a special meeting of the members of the organization shall be called, with necessary notices, for the purpose of filling such vacancy.
Section 4: The following actions shall disqualify a Director from the Board, and will result in immediate notification of his/her termination:
(A) Failure to attend 50% of regular or board meetings during the course of a calendar year, or failure to fulfill the duties of their position;
(B) Failure to pay dues in a timely manner; and
(C) Failure to comply with the by-laws of the organization.
ARTICLE 8
Section 1: The Board of Directors shall hold regular meetings at any place and time as fixed by the Board.
Section 2: Special meetings of the Board of Directors may be called at any time by the President or shall be called by the President upon the request of three members of the Board with thirty days written notice to each Director stating the time, place, and subject of the meeting.
Section 3: A quorum for the transaction of business by the Board of Directors shall be four.
ARTICLE 9
Section 1: It shall be the duty of the President:
(A) To preside at all meetings of the Board of Directors and to see that the by-laws and directions of the Board of Directors are observed and enforced.
(B) To present annually and at such other times as he/she may deem necessary, a full report of the condition of the organization, accompanied by such accounts of its business as he/she may deem necessary.
(C) To appoint such committees as may be necessary from time to time to properly conduct the affairs of the organization.
(D) The President shall be member ex-officio of all committees.
(E) The President shall have the privilege of voting on all questions before the Board of Directors.
Section 2: It shall be the duty of the Vice-President:
In the absence or incapacity of the President, the Vice-President shall have the power to perform all the various duties and offices of the President.
Section 3: It shall be the duty of the Secretary:
(A) To keep the customary corporate books, records and membership verification records, with the exception of those specifically assigned to the Treasurer.
(B) To maintain the minutes of the meetings, to register the members, and to keep the by-laws complete and up to date.
(C) To send out proper notices of all meetings and conduct the correspondence of the organization.
(D) To sign with the President, all contracts, deeds, or other instruments of the organization.
Section 4: It shall be the duty of the Treasurer:
(A) To maintain the financial records of the organization, and to submit such records to an auditor as appointed by the Board of Directors. The results of any audit performed shall be reported to the membership at the next scheduled annual meeting following completion of the audit. The Treasurer shall prepare and maintain monthly reports showing all club expenses and revenues incurred each month, as well as an itemization of all organization checks written each month.
(B) To have custody of all funds and securities of the organization, and when necessary or proper, to endorse on behalf of the organization, for collection, checks, notes, or other obligations, and shall deposit all funds to the credit of the organization in such bank or depository as the Board of Directors shall from time to time designate.
(C) To sign all receipts and vouchers for payment. All organization checks must be signed by both the President and the Treasurer.
(D) To render a statement of his/her cash accounts, whenever required by the Board of Directors, and shall regularly enter in the books of the organization, to be kept by him/her for that purpose, full and accurate accounts of all monies received and paid for and on account of the organization.
(E) To be prepared at all reasonable times to exhibit the books and records of accounts to any member of the Board of Directors upon application at the office of the organization. The members of the organization may review the monthly Treasurer’s reports at a regularly scheduled board or membership meeting, or upon written request to the President.
(F) At the discretion of the Board of Directors, the Treasurer shall also be bonded with corporate security in such form and in such amount as the Board of Directors may require, the cost for which shall be paid by the organization.
ARTICLE 10
Section 1: No area within the boundaries of the BLWC shall be used as a dumping ground for rubbish. Trash, garbage, or other waste shall be kept in sanitary containers.
Section 2: Right-of-way for utility service is reserved from the said premises for all utility companies. Said utilities having and reserving the rights to install, maintain, repair, and replace said lines as determined by the utility companies and the BLWC.
Section 3: As a general rule, timbering and wood cutting on member-owned lots is limited to clearing space for a driveway and parking, a dwelling unit, a garage or other outside storage facility and a yard area. Timbering and cutting of dead, diseased or otherwise damaged trees is also permitted to the extent necessary to eliminate safety concerns, or to assure the health of other trees or shrubs on the property. No clear cutting on any member-owned property within the BLWC subdivision is permitted. Timbering or cutting on BLWC-owned property is only permitted if approved by a majority vote of the members present at a regular or special meeting.
Section 4: Courtesy and sportsmanship is expected of all members, associate members, grandfathered property owners and all guests. Fishing, boating and hunting, to the extent permitted by the organization, must be conducted in compliance with the rules and regulations of the BLWC, Pennsylvania Game Commission and the Pennsylvania Fish and Boat Commission. Current BLWC boat decals must be displayed on all boats using the lake and shall be issued and controlled by the Board of Directors.
Section 5: No animals, livestock, horses, or poultry of any kind shall be raised, bred, or kept, with the exception of dogs, cats and other household pets.
Section 6: Only small name signs may be placed, not to exceed a size that is considered appropriate by the BLWC.
Section 7: BLWC will maintain liability insurance on the club property.
Section 8: Guests of members of the organization are permitted to use the facilities of the organization, including the lake and common ground provided, however, that the member must be present at all times with the guest during such use. Guests are subject to all by-law provisions related to use of BLWC property, as well as to all other applicable rules and regulations of the organization.
